Wikipedia says 30 percent of time laws are upheld when subjected to strict scrutiny. It's interesting that in this case, the law could very well survive strict scrutiny, and it may. But of course it shouldn't have to, it should just be a reasonable relationship test, or some lower standard.

Civil rights organizations support protecting the law, not overturning it. The radical exercise was for the court to take the case, and to reflect that private one to one therapy sessions involve first amendment considerations that override a states legitimate interests in regulating therapists.

Fact is we have zero idea how this court will rule or even what it will be when this comes around. It does no good to give up because of a possibility. It’s scary and it sucks. It’s not over.

Did you read the opinion or concurrence? Do you know the procedural posture? Did you read the opinion of the 10th circuit panel? Do you understand how courts work?

My understanding of the concurrence is it's saying that counseling "the other way" is also viewpoint preference. But Shannon Mintner emphasizes that the law is only, textually, prohibiting pre-determined outcomes and has no text in it that prefers any outcome or supports these justices' concerns.

Chiles v Salazar is a trojan horse. If Chiles wins then we can ALL claim to be doctors and recommend bleach to our patients. It's about NOT allowing states to license healthcare professionals.

Thanks... It's so important but across mainstream media, decisions are impossible to understand correctly. Media view is that people can understand the most complex technology but not the concept of strict scrutiny, or whether "speech" is political, or whether it takes place in a "public forum."

They are the same thing based on the same false premise that gay men were too feminine and the most extreme version was men who wanted to be women. Conversion therapy and ABA therapy which was devised by the same sickos is about torturing kids into confirming

true..but now, basically impossible any lower courts can apply "hightened scrutiny" involving conv therapy AND favorably rule for CT bans under free speech/religion. CT bans are effectively dead. and w/ Skrmetti, almost no limits now to bans AGAINST affirming care, but abuse is free speech/religion

It's actually worse, tbh. Way worse. At least masterpiece was narrowly decided.

That stuff with Byron Noem makes me laugh. But it's really kicking someone when they're down at this point. Keep kicking her, hard, she earned it 100%. Leave the poor man alone. There is literally nothing wrong with his role play / costume / expression. He may be a hypocrite, but enough is enough.

Even if conversion therapy bans are struck down, can't states treat it like "solicitation"? Ban anyone from paying for it. Having sex is not illegal. Discussing paying for it is. I can see it now: "conversion therapists" on the street corner approaching cars: "hey, looking for a terrible time?"

Thank you for thinking through this and sharing your insight with the rest of us. I think a lot of trans people are quite reasonably panicking rn, including me for much of the day, so I'm really grateful you took the time to not only say this, but in an unambiguously affirming way
