Worth observing for the laypeople out there that in addition to being the former Yale law dean, the author (Robert Post) is also one of the most important First Amendment scholars *and* academic freedom scholars, like, ever. He knows whereof he speaks more than basically anyone

Jeremy Stahl

The Trump administration sued Yale for its admissions policies (alleging too much diversity). Yale is negotiating with DOJ, whereas Harvard fought Trump. The former dean of Yale Law School thinks he knows the real reason why. slate.com/news-and-pol...

Oh, it's bad. He doesn't say Blanche is pulled, but, he does. I think the only fair reading of this is that Trump is not willing to let Blanche back down on the audit immunity.

Chris Geidner

NYT on the Blanche vote delay that’s the result of Cornyn and Tillis not being on board due to where things stand with the IRS audit immunity provision. “‘I can see why he wants it, because it provides immunity from audits no other taxpayer would get,’ Mr. Cornyn added. “

The Trump administration is asking #SCOTUS to put back into effect its executive order giving the USPS more control over mail-in voting. Today's bonus "One First" explains why this is a purely procedural dispute at this juncture (about standing/ripeness)—albeit one the government should still lose:

Bonus 241: The Mail-In Voting ApplicationsWhat the Court was asked to do on Monday is narrower than much of the coverage suggests—and a grant of relief would be far less significant than it may appear.www.stevevladeck.com

Ironically, Ho abandons his previous defense of birthright citizenship in a speech on "judicial courage" and judicial selection because the new litmus test for a Trump Supreme Court pick is a willingness to end birthright citizenship.

Lawrence Hurley

Judge Jim Ho out there airing his opinions on a bunch of legal questions, including those he thinks SCOTUS got wrong (gay marriage, birthright citizenship, etc): reason.com/volokh/2026/...

"His for-profit company is seeking to wrap itself in the mantle of voting rights to make the case for a gambling activity that states have ample reasons to choose to discourage, while no one’s constitutional rights are being infringed. Freeman is not John Lewis."

Hmm

Doug Lindner

This would be a good year for some other outlet to start (1) a liveblog of SCOTUS decision days and (2) a user-friendly SCOTUS docket tracker. SCOTUSblog is a gatekeeper because they're the ones doing those things and the Court's own website is meh, but they should not be the gatekeeper anymore.

"Chief Justice Roberts delivered the opinion of the Court. At issue in this case is whether the First Amendment protects the fundamental liberty to wager money in support of one's political beliefs. Following the standard set forth in Citizens United, we hold . . . "
