I would say that DOJ prosecutors just did the same thing that they're accusing the defendant of having done, but the defendant may have done it for public-minded reasons whereas DOJ prosecutors did it carelessly and in the context of an effort to suppress a report that the public has a right to see.

This lawsuit was a cynical, dishonest, and confused effort to punish tech researchers and others for exercising core First Amendment rights. It should have been thrown out a long time ago, but better late than never.

Today we beat Stephen Miller’s lawsuit mill in court! For 3 years I’ve been a defendant in a case filed by America First Legal on behalf of Gateway Pundit & a random antivaxxer we’d never heard of until she sued us. The plaintiffs claimed we “censored” them. It was a lie. They just lost.

American lawyers who are wondering and agonizing about the role their profession is playing in the dismantling of this democracy should to listen to this podcast and get all of their friends to listen to it, too.
