We've been using punishment in response to crime for like 6,000 years and have gotten nowhere with crime. It might not work.

Both are true that America needs to abolish its modern prison system and there will still be people who need to be restrained because they cannot hang out without being assholes. The latter however, is probably only 5-15% of the current prison population and most politicians.
