There is literally no way to interpret any law that would give Beshear the power to appoint a Senator while McConnell draws breath & 0% the Senate would seat whomever he sent

Allison Gill

BREAKING: Beshear sends strongly worded letter to McConnell. He should appoint a Democrat to fill the seat.

As Mitch isn’t voting or chairing his committees why do so many dems, on social media, want to force the GOP to replace an inactive senator with an active one or for the Governor to do something stupid, performative or illegal which achieves nothing except possibly getting him impeached?

Ответ для AlanR

It's insane. The masses are ignorant, I suppose, but there are a lot of influencers just pumping the outrage because it pays for them. So frustrating.

3k likes though - people are addicted to the easy likes

Ответ для Matthew Downhour

i mean i agree with your legal analysis on all of this but i do think it's maybe a bit beside the point here. the fascists are losing most of their illegal actions too. but they're winning a few, here and there, inconsistently.

Ответ для depose schumer

(and stipulated, given the state of the judiciary, it'd be even more inconsistent for us. but.)

Ответ для depose schumer

But it’s silly, you can’t appoint a Senator to a seat that isn’t vacant

Ответ для Matthew Downhour

what does vacant mean? i think i know what it means. you do too i'm sure. but hey, maybe it means something else. don't know until you try. 1% success rate is basically nothing but what the fascists have realized is that if you're running that simulation hundreds of times, it's very much not nothing

Ответ для depose schumer

99% failure rate when failure means you definitely get impeached is not good odds

Ответ для Matthew Downhour

Republicans get away with what they do because they have legislative majorities

Ответ для Matthew Downhour

i'm not really sure that they need a reason to impeach if they had the votes, tho. it's essentially the gerrymandering play all over again, and we have real natural experiments in how r legislatures treat that

Ответ для depose schumer

after all, there's a "whole body of literature" that says vacant means something other than what you and i think ;)

Ответ для depose schumer

They have 32 of 38 votes in the Senate. As we saw with gerrymandering, legislatures are finicky & do in fact respond to provocation

Ответ для Matthew Downhour

They don’t impeach because Beshear is popular; he is popular because he follows the law. If you does something obviously unlawful, they have a good trigger to impeach

Ответ для Matthew Downhour

ha fair, and not to belabor the point but are you referencing D leg's? because i agree, but i think the defining feature of this era is that D and R pols are simply built different, and in general (yes a few mostly incense margin cases), Rs don't need provocation, either they can do it or they can't

Ответ для depose schumer

*mostly inconsequential

Ответ для depose schumer

I think it’s quite the opposite - R have had the capacity to gerrymander for some time, but only actually started doing mid cycle maps recently - & not always (see:Indiana)

Ответ для Matthew Downhour

well yeah same could be said of dems, and at the risk of upsetting the bluesky Narrative, no Rs weren't always Like This, it's new

Ответ для Matthew Downhour

How does Beshear force the issue, and prove Republicans aren't using a corpse to hold onto a Senate seat? That would otherwise seem actionable as well. He could withdraw the appointment on proof of McC's living, making impeachment moot.

Ответ для Tim Wood

Using a corpse to hold McConnell in the Senate seat just deprives them of a vote and kills their committee advantage on several committees. If they want to do that let them.

Ответ для joofie57

If McC. died, they're doing this (ostensibly against their interest) because they fear Beshear will use his power under the state Constitution to appoint a Democrat. That would imply they know the recent laws requiring a special election are unconstitutional. @matthewdownhour.bsky.social

Ответ для Tim Wood

McConnell is not dead

Ответ для Matthew Downhour

He is unable to vote but he is not dead and refuses to resign. This leaves Republicans down a seat but is not uncommon old Senator behavior (see: Diane Feinstein)

Ответ для Matthew Downhour

Feinstein's health status during hospitalization was public knowledge via firsthand reporting. She returned to serve 4 more months and cast votes before she died in 9/2023. The Senate GOP (led by one M. McConnell) refused a replacement for her on Judiciary. The GOP is hiding something here.

Ответ для Tim Wood

McConnell is extremely sick and likely will never return. He refuses to admit it

Ответ для Matthew Downhour

Then he needs to give firsthand, public evidence to that effect so the Senate process for disability can proceed. Otherwise Beshear needs to dispense with the strategic ambiguity crap.

Ответ для Tim Wood

Why? Republicans are down a vote.

Ответ для Matthew Downhour

If Beshear pushes it he’s betting on the Kentucky Supreme Court siding with a Democrat. What do you think the odds of that are

Ответ для Tim Wood

your first sentence is a very good point for senate Rs to consider your second sentence not only let's Rs off the hook, it says they should be *rewarded* for not stepping up

Ответ для CB

2nd sentence rewrite: Otherwise Beshear needs to call the Ky. GOP on their bluff.

Ответ для Tim Wood

Why would Beshear object to a corpse holding the seat & not voting

Ответ для Matthew Downhour

Because event would constitute fraud on the State of Kentucky by the GOP. As I read it, the Ky. Constitution gives the governor the right to appoint a replacement Senator in the event of death, but the legislature passed laws requiring a spcl. election. But that does not amend the Constitution.

Ответ для Matthew Downhour

Send us proof that the turtle is still alive. That's the Governor's point. Trust me bro does not count.

Ответ для Matthew Downhour

Beshear can't appoint anyway. He can only call a special election. That's my understanding

It's MSW, of course it's nonsense

He should announce and schedule a special election on the assumption that McConnell is dead. If he’s not, let them prove it.

Ответ для Ivan Moore

Why do you think Beshear should take action to give Republicans more votes in the Senate? Do you really want Reconcilliation 3 to pass or something?

Ответ для Ivan Moore

That would be a profoundly stupid assumption on Beshear’s part and would result in his immediate impeachment and removal from office.

Won't know for sure unless you try though.

This unseemly game the gop is playing with McConnell’s status has suddenly reminded me in a bleak Black Mirror crossed with Idiocracy kinda way of the Terry Schiavo case.

Damn it, the play is to signal boost Beshear, not this shit

Granted, it’d be bound to ultimately fail. Yet, a declaration to fill the seat due to Mitch’s unfitness to serve atm could trigger McConnell/staff to challenge it. Beshear could announce he’ll happily stop proceedings as soon as Mitch is seen alive, in person, by multiple people, on live cameras.

don't play reverse Russian roulette don't play Russian roulette with a semi-automatic pistol

Ответ для CB

Does that come with a decoder?

Let the AI begin!!!!! I need visual proof.

It is incredibly fascinating for outside observers to watch the delicate balancing act the governor is performing to avoid having to visit the ailing senator. Could he actually be turned away at the sickroom door? What would the real consequences be if he were a) in a coma or b) actually dead?

Ответ для Zero

Yes, he would be turned away for the same reason you would be turned away.

Ответ для Flow Void

What (kind of) reason?

Ответ для Zero

Hospitals don't allow unwanted guests into patient rooms.

Ответ для Flow Void

I understand that. But if a patient holds an important public office, why isn't there a (daily) medical update from the attending physician—who could authorize public visits? Even just a one-minute update would suffice proof of life.

Ответ для Zero

Only the patient can authorize visits and public medical updates. There's no exception for VIPs, politicians or otherwise. So we only know what Mitch McConnell wants us to know.

Ответ для Flow Void

If I held an office like this, I would ensure that the world knows I am fit enough for the position.

Ответ для Zero

Well you're a better person than Mitch McConnell

Ответ для Flow Void

Not for sure, to be a better person. I’ve done a lot of stupid things in my life, but I can still stand the sight of myself in the mirror and I can speak about. But for shure: I certainly don't hold such an important position.

That’s not the point. The point is to force some action, not to debate the protocols of the Kentucky legislature. That’s what McConnell would have done, fcuk the rules. And is he even drawing breath? 🙄

Ответ для wakandangriot

If a Democratic Senator were hospitalized and missing votes, McConnell would be pretty content to let them keep missing votes. We know this because it happened just last year with Fetterman’s hospitalization.

Ответ для Queerhawk 🏳️‍🌈 | 🇺🇦 | 🇬🇱

Mitch McConnell wasn’t the governor of Pennsylvania. So we don’t know this. Idiot. Any senator that would use his power to prevent a sitting president from making a SCOTUS a year out from the end of his term would do anything.

Ответ для wakandangriot

If Dems take the Senate, every one of them will use their power to prevent Trump from making any SCOTUS appointments at all.

Ответ для wakandangriot

“So we don’t know this. Idiot.” Is there a specific reason you’re unclear on why someone from Party A would want members of Party B to keep missing votes, or is there no particular reason for your confusion.

He can call a special election but I'm not seeing how that helps democrats. A republican is most likely to win.

Ответ для ABOLISH ICE NOW!

Even if a Democrat won, it doesn’t change the math that much. 53–47 and 52–48 are practically the same things. This doesn’t even affect the net gain needed for the midterm either. That seat is already up for an election this year.

Ответ для ABOLISH ICE NOW!

He can't call an election until he sees a death certificate or McConnell resigns.

oh, so we are following the law now. That has never stopped the GOP.

Ответ для Raille
Ответ для Caesar Catalina Wine Mixer

your question says all we need to know.

Ответ для Raille

the question mark indicates sarcastic upspeak. legal guardrails have, in fact, stopped Trump and the GOP many times. aside from which, there's zero incentive for Beshear to push his luck here

This is starting to get my on nerves I hate when big accounts lies to their followers for attention

What if he, I don’t know, walked into the facility he’s being treated at? Beshear has the power to force the issue if he was bold. If roles were reversed there would be no decorum whatsoever. Take the gloves off. Fight before there’s nothing left to fight for.

Ответ для Sigh

Why should Beshear fight for more Republicans being able to vote in the Senate?

Ответ для joofie57

And get immediately impeached by KY legislature for his troubles?

Ответ для ginya1

Good! Fucking DO SOMETHING! Ever ask yourself why you’re such a fucking cowardly piece of shit? Wake the fuck up! It’s almost over you shit heel. You’re under a fucking boot and all you think of is appearances and rules. You’re pathetic.

Ответ для joofie57

Cowardice wrapped in stupidity. Look in a mirror bootlicker.

Ответ для Sigh

Repubs are down a vote with Mitch on permanent hiatus. This is a PR dream for the Dems. All they need to do is concern troll and point out the massive employment and benefits fraud. There's currently no benefit to ambushing a medical facility for curiosity or internet points.

Ответ для Sigh

Walking into a hospital shouting “I’m the Governor!” would not allow hospital staff to disclose information about any particular patient, for one.

Ответ для Queerhawk 🏳️‍🌈 | 🇺🇦 | 🇬🇱

Surely the people of Kentucky will approve of their Governor barging into their longtime Senator's physical therapy session

Ответ для Acornloaf

My bad. We should just accept our fascist rulers and do nothing. It’s all about decorum. That’s what’s important. Maybe another press conference will get it done. That’s it! JFC I’m surrounded by fucking cowards. Watching the floor disappear from under our feet and you’re worried about optics? 🖕

Ответ для Queerhawk 🏳️‍🌈 | 🇺🇦 | 🇬🇱

Yeah you’re right, fighting the rise of fascism is supposed to be much more polite. What was I thinking.

Ответ для Sigh
Ответ для Queerhawk 🏳️‍🌈 | 🇺🇦 | 🇬🇱

I’m not saying “Heavens to Betsy, that would be rude!” I’m saying that even if Beshear barged into a hospital shrieking like a lunatic that McConnell is dead and demanding to see him, as you’d like him to, he would just be escorted off the premises and you’d be upset he didn’t Do Something More.

Ответ для Sigh

everyone knows that demanding completely ineffective PR stunts is the way to fight fascism what Beshear should really do, though, is just post stupid ideas on BSky

Ответ для CB

You disgust me

Ответ для Queerhawk 🏳️‍🌈 | 🇺🇦 | 🇬🇱

Especially since the hospital is in DC, which doesn't have a governor

Ответ для Sigh

Why? So they can run a special election Republicans will win?

Ответ для Sigh

Beshear has no power in DC, which is where McConnell is being treated.

Sure, but keeping this issue in the news is objectively a good thing. “Republicans will keep a dead guy in the seat rather than respect the voters” is a great attack line, even if it’s not completely true

Ответ для 29 U.S.C. § 157

The line from Beshear is good - demand McConnell resign! The “Beshear is weak for not appointing a pretend Senator” is just engagement slop

Ответ для Matthew Downhour

100%

the point is to force the gop hand in ky. they took that power away from the gov right before he was seated and that is against their own state constitution. if he appoints it forces the gop to act ie show us the corpse or go to court where the gop will lose and power to the gov will be reinstated

Ответ для idnarb 🐝 📎

also, people in ky are lacking representation because mitch is mia

Ответ для idnarb 🐝 📎
Ответ для Queerhawk 🏳️‍🌈 | 🇺🇦 | 🇬🇱

They should prove it. The distrust is imbedded. Republicans recently were found hiding the fact that Kay Granger has dementia and was living in an assisted living facility and not voting. It took 6 months before she was found. Texans were but being represented during that time either.

Ответ для idnarb 🐝 📎

“They should prove it” They have. I can’t help if you think hospital staff are lying and that photos of him are fake.

Ответ для Queerhawk 🏳️‍🌈 | 🇺🇦 | 🇬🇱

i don't need you to help me 😂 mcconnell is untrustworthy pos who would demand the same from any democrat if he felt he could manipulate the situation for more political power beshear is calling for an actual update. the people of ky deserve better than his absence

Speak or resign: Beshear ups demand for McConnell health statusMcConnell's absence is fueling speculation about his capacity to serve.www.axios.com

The very act of appointing someone would should force their hand. It’s a no lose situation

Ответ для Dan Eckhardt

Force their hand to do what? They can simply impeach him & refuse to seat the appointed Senator

Ответ для Matthew Downhour

lol. Troll
