How does Beshear force the issue, and prove Republicans aren't using a corpse to hold onto a Senate seat? That would otherwise seem actionable as well. He could withdraw the appointment on proof of McC's living, making impeachment moot.

Because event would constitute fraud on the State of Kentucky by the GOP. As I read it, the Ky. Constitution gives the governor the right to appoint a replacement Senator in the event of death, but the legislature passed laws requiring a spcl. election. But that does not amend the Constitution.

Using a corpse to hold McConnell in the Senate seat just deprives them of a vote and kills their committee advantage on several committees. If they want to do that let them.

If McC. died, they're doing this (ostensibly against their interest) because they fear Beshear will use his power under the state Constitution to appoint a Democrat. That would imply they know the recent laws requiring a special election are unconstitutional. @matthewdownhour.bsky.social

McConnell is not dead

He is unable to vote but he is not dead and refuses to resign. This leaves Republicans down a seat but is not uncommon old Senator behavior (see: Diane Feinstein)

Feinstein's health status during hospitalization was public knowledge via firsthand reporting. She returned to serve 4 more months and cast votes before she died in 9/2023. The Senate GOP (led by one M. McConnell) refused a replacement for her on Judiciary. The GOP is hiding something here.

McConnell is extremely sick and likely will never return. He refuses to admit it

Then he needs to give firsthand, public evidence to that effect so the Senate process for disability can proceed. Otherwise Beshear needs to dispense with the strategic ambiguity crap.

If Beshear pushes it he’s betting on the Kentucky Supreme Court siding with a Democrat. What do you think the odds of that are

If McC. has died, Beshear has an argument, and a criminal case against anyone in on the conspiracy. If Beshear appoints with McC. alive, he can stand down. Then the GOP can answer why they covered up the affair to that point.

Not very. But B. can demonstrate legally the GOP side has gone wrong here (fraud, obstruction), if McC. is alive or not. Operation of law requires an answer as to McConnell's true state.
