We don't ordinarily publish posts at [checks watch] 8:51 PM on a Friday night, but state constitutional law expert Quinn @yeargain.bsky.social has an outside-the-box idea for reversing the VA Supreme Court that is very much worth taking seriously: Dems can simply lower the retirement age.

How Virginia Democrats can overturn the redistricting ruling: Retire the Supreme CourtThe state Constitution gives lawmakers complete latitude to set the judicial retirement age. They should use it.www.the-downballot.com

I fully support this. I’m tired of bringing a pillow to a knife fight

Damn. I love this. It’s exactly something that republicans would do, and in a zero-sum bloodsport, you’re forced to play using the same rulebook.

Ответ для danmontie

They just abolished a whole constitutional office in Louisiana to prevent an elected Black Democrat from taking power.

Ответ для ERTBen

True

This is so cute and funny lol Total fantasy of course

Ответ для DC Yankee 🏳️‍🌈🇺🇸

There are many reasons but start with the fact there's no way to rehear the case. New judges don't matter anymore.

Ответ для DC Yankee 🏳️‍🌈🇺🇸

Dems aren’t THAT bold.

Ответ для Lummus Cain

I'm deadly serious—do it. This is the level to which the Republicans have had us all sink. You know the GOP Federalist Society looks for every nook and cranny they can exploit to bend the rules in their favor. Democrats must save this country. Desperate times call for desperate measures.

This is an exquisite solution - especially because it's a technicality, since the VA court loves technicalities so much.

(based on Wikipedia research, so...) Against (all white, btw): Chafin - 70 Kelsey - 64 McCullough - 54 Russell - 55 or 56 For (2 black, 1 white): Mann - 60 or 61 Fulton - 67 or 68 Powell - 69... birthday in January Make it 70 & appoint 1 new justice

Sunset any laws you adopt. Just get it done. Pronto. Vamoose.

Sounds good to me

So once they retired them, how quickly could they confirm a brand new Supreme Court?

This is brilliant and this is how Dems have to fight if they want to win.

Other states in similar situ should look at this idea as well. NOW.

And cut their salary. A lot.

Ответ для bloodhounder

No, that’s how you get corruption

Ответ для James

You say that, but clearly the current salary levels haven't prevented corruption.

Ответ для The bird says, "Prosecute ICE"

Lowering them would make it worse! Also I’m not sure this ruling has anything to do with “corruption”. Seems partisanship or outcome driven, not because someone dropped a lot of money in VASC’s pockets

Ответ для bloodhounder

Yeah, make sure only independently wealthy people run for office. That’ll help. /s

Ответ для Hoon McMunch (in space*)

Good point. But they don’t run for this office. And the General Assembly salaries are way too low as it is. My point is to get this bunch of judges out and put people in that understand and plan to do their job.

Legislatures are supposed to make law for the benefit of the people; Courts are supposed to interpret law impartially. The SCoVA clearly made a political ruling, so it's appropriate for the legislature to counter them. If the country ever gets a Dem Congress & President, there will be lots to fix.

I freaking love this! Fight fire with fire!!!🔥

I love it. This is exactly the kind of mean, nasty, Machiavellian, Mitch-McConnellian kind of move I want Dems to do. If they pull out a flame thrower, we pull out a bazooka and fight back.

Ответ для daringfuture

Sadly Dems will wait 20 years to do this

Ответ для DB

They’ve already rolled over and said they’re going to respect the ruling. Fuck this party.

Ответ для Matt Perri

Of course they have.

Ответ для Matt Perri

Radley Balko

We've reached the point where one party has so obliterated the rule of law that everyone else continuing to abide by it will only hasten the end of our democracy. That's a recipe for chaos and violence. It's terrifying, and I don't know what we do about it.

Ответ для Matt Perri

This does still respect the ruling though. Just as they should respect the ruling of the replacement court which overturns it

Ответ для markmcan

Sure…but it will never happen because the Dems are meek little kittens who’d rather play fair than bring a gun to a knife fight.

Ответ для Matt Perri

It's so scary how much they don't realise the danger. Can't reason with psychos

Ответ для markmcan

And the GOP knows they’re meek and they just continue to run over them.

Ответ для Matt Perri

Lol, no they haven't. They immediately notified the court they were filing an appeal. Why lie? Seriously, why LIE?

Ответ для Kacey325

Because of your comment, I looked into it, and yes, it does seem that an appeal will be filed. So that's good. The challenge is that the appeal is to the US supreme court, which doesn't need to take the case, or rule quickly. So we'll see.

Ответ для daringfuture

This right here. They’ll delay it if they take it at all.

Ответ для Kacey325

Seriously…why do any research when you can scream at someone online?

Ответ для Matt Perri

You were saying,? 🤔Or are you going to pretend they aren't appealing----- exactly as I said they would? Or are you going to continue to lie about what they're doing?😉

Ответ для Kacey325

I stand by what I said. They clearly said they were going to respect it. It’s not a lie. They was said. And you’re actually excited about it being appealed to the SCOTUS?! Really?! You think the 6-3 Trump kangaroo court is going to overturn this?! IF they hear it at all?!

Ответ для Matt Perri

You stand by your LIE. You still LIED. You said they weren't going to do anything which was a LIE. I provided you with a visual stating that SCOTUS was only ONE avenue lmao. You just can't stand the fact that you got caught. A real man would own up to it. But you have shown your ass😉

Ответ для Kacey325

I literally posted the congressman who said he would respect the ruling. He’s being called out for being a coward for saying it. It wasn’t a lie. It was the truth. I never said they weren’t doing anything. You can’t appeal higher than SCOTUS. There is no “other avenue”. Get a fucking grip.

Ответ для Kacey325

I’m a liberal, you absolute chucklefuck. I saw this coming miles down the road. I knew it would be blocked. I knew the SCOVA was going to kill it because they are tilted for Trump. And SCOTUS isn’t going to save it, either. They will not grant cert. it’s over. The Dems need to get nastier.

Ответ для Kacey325

And it’s done. SCOTUS rejected the case. They didn’t even hear it. Told you. And they won’t fight it either. It’s dead.

Ответ для Kacey325

And it was rejected by SCOTUS. And the Dems will roll over and accept it like the wussies they are.

Very cool. ( and amend the U.S. Const. art. I, § 2, cl. 2, "No Person shall be a Representative who shall not have attained to the Age of twenty five Years { or surpassed the Age of of sixty five Years }"

I had no idea but do it now fuck those Republicans 🤞🙏💙

Great idea AND constitutional! Win win! 👍🏻

I love this idea. Get this in front of VA Democratic legislature leadership ASAP!

This is a no-brainer.

I love this. Do it. They want to play dirty? We can, too.

Contact people in the VA Senate to consider this

They should be retired. They acted against the will of the people. Bye bye

Or pack the court

Damn.

The other legit idea? Call the legislature back, pass a law defining “election” even more specifically than it already is, make that change retroactive to Jan 1. Then use the new maps and dare the treasonous Repubs to fight it.

@therickwilson.bsky.social @vademocrats.bsky.social @50501virginia.bsky.social

Stupid to dump the whole court. It was a 4-3 vote. Why not list the judges by age and vote so we can figure out if this makes sense.

I love it! Do it!!!

This is the way

Tell this to Louise Lucas, man

This is so fucking based.

And 54 is still plenty young enough, to get a new full time job. 😉

We would just be following Republican precedent. They ordered rehearing of a North Carolina Supreme Court redistricting case in 2023 to overturn it, after elections changed the court’s membership. It was good enough for the GOP then, should be fine for Dems today.

VA's current judicial retirement age is 73—an entirely arbitrary number. Resetting it to 54 would require every justice to retire, allowing for an all-new court. Of note, VA public employees can collect partial pensions from the state's retirement system starting at age 55.

Ответ для The Downballot

The VA Constitution gives lawmakers unlimited latitude to set judicial retirement ages. And to make any change take effect right away, Dems can attach it to the biannual budget bill, which is still in the works.

I think we would be outraged if a republican legislature tried it.

Ответ для Randy Clayton

Of course. But they already have done this kind of stuff and worse. We have to play the game in front of us.

Ответ для Randy Clayton

Do you care about hypocrisy or do you care about winning? Whether the invitation was to a knife fight or not the other guy has a gun

Ответ для Ideology Eater

False dichotomy. We don’t have to be hypocrites to win.

Ответ для Randy Clayton

Hardball is distasteful but unilateral disarmament in the face of fascism is worse.

Ответ для Randy Clayton

Yes, because they are fascists and wish to do harm to the country

Ответ для Randy Clayton

I'm already spending every minute of every hour of my day outraged by Republican Legislatures.

Ответ для Randy Clayton

Sure and only thing that would outage me more is if a bunch of Democrats sat around and just ate shit in response because they thought they were dealing with a legitimate political party and not the criminally reconstituted Confederacy.

Ответ для The Downballot

THANK YOU. I have emailed both of my electeds and will make sure as many people know about this option as possible. SIC SEMPER TYRANNIS

Ответ для The Downballot

I would pay to watch them receive their dismissal notices.

Ответ для The Downballot

Make it a specific amount of days intended obviously to be a bill of attainder and then when they sue, arrest them with a SWAT team in the middle of the night and drive them in a paddywagon to Texas with no food or drink, and drop them off in the middle of downtown Houston with a bus ticket.

Ответ для Numbcat9

Or be gigantic wimp Democrats who have no idea how to govern and no guts either because they won’t use literal hammers to solve the Sons of Confederate Veterans problem.

Ответ для The Downballot

Who thinks up these fucking stupid ideas??

They should do it, but won't

DO IT @abigailspanberger.com

Oh boy. I don't like it. But this is where we are. Perhaps they should do it. I like it more than their current approach of appealing to the corrupted, illegitimate US Supreme Court.

Ответ для Andrew C. White

It’s not “perhaps” it’s “yes this is the solution.“ Do it.

They could, but I'm concerned that the other side will file a lawsuit and shut this down in the courts very quickly (including court shopping). I think they should look into either having retention elections, or make judicial races be nonpartisan, and have it be a constitutional amendment.

LFG, @vademocrats.bsky.social

@kirkmcpike.bsky.social

Brilliant. Love this idea. 2 can play that game. Get to work VA Democrats

We need to stop trying to follow norms when we're in a gun fight. They just dismantled the voting rights act and are disenfranchising black people across the south. Whatever is within our power, we need to do.
