These cases expose just how bizarre it is to have an immigration system that effectively falls outside of the criminal + civil legal systems. The criminal system has already dealt with these charges, yet our "non-punitive" immigration system can be weaponized to harm them years later.
Aaron Reichlin-MelnickI post this not to in any way morally justify her detention. In fact, under previous admins, she likely never would have been detained as CBP would likely have decided just to issue a Notice to Appear and sent her on her way. But, systemically, this is 100% legal and we need to grapple with that.
