Maybe. The statute uses words like "takes any action" or "knowingly attempts" to destroy evidence. You could argue there is a difference between typing the code yourself and giving LEO the code and them typing it in.

Exactly. But the post said he typed it himself, and the indictment (storage.courtlistener.com/recap/gov.us...) is silent on the issue.

This post says Tunick typed in the duress passcode, but the article says he gave the officer the code and the officer typed it in. Can you clarify which it is? It could be meaningful under the statute he's charged with violating.

What’s interesting to me is the article quotes some experts that have never seen this statute (www.law.cornell.edu/uscode/text/...) applied this way. I can see some wiggle room with “knowingly…takes any action” under this but I’m with Eva - I wouldn’t want to be the first one to try it.

When I took it, some poor woman's laptop crashed about halfway through the essay time too. She went up to the proctor, they handed her a bluebook, and she went back to her seat and just started writing by hand. I think about her about once a month and hope she's doing okay.
