Arguably they have to provide notice to Congress well after the fact about use of the judgement fund, the Trump settlement also made an end run around that notice. But that only occurs the following year so it’s not even a way to stop them from moving forward.

Trump settlement simply added a new process for seeking and resolving such settlements, without it they can still do them without any notice.

They would have to pass legislation barring administrative settlements of this nature. Even without the Trump agreement DOJ has taken the position they can make administrative settlements with no public disclosure or oversight and use the judgement fund.
