Tbh, i think it's pretty reasonable to hate the party doing fascism and also hate the party who failed to stop fascism and is feckless in resisting it.

Heartbreaking that the parties had to go through this for so long, spend so much time and money, but at least they did get this vindication.

But at least you, the person reading this, will know that.

Lynne Freeman got a write up in the fucking New Yorker to turn people against Tracy Wolff and it absolutely fucking sucks that all the people who read that salacious piece will never know that Lynne Freeman lied to the court, conducted this litigation in bad faith, and had absolutely zero case.

So from a very personal perspective: Lynne, you shoulda listened when I said that the evidence you were presenting was not proof of copyright infringement.

Finally, I want to say a thing: Lynne Freeman has been TRASHING Tracy Wolff for years. When I said that it did not sound like she had made a claim that met the legal standard for substantial similarity, she sent people who were clearly connected to her to whip people up against me.

I am still reeling from the judge saying "notwithstanding Freeman's status as an attorney herself, she would do her utmost to avoid or evade compliance with any court order that she did not like." What a thing to have said about you in the court record.

2, Freeman is absolutely going to lose her appeal, there is zero merit to her case, absolutely not a chance she will win, no way, no how.

Finally, Judge McMahon says that Freeman must put in a $150,000 appeal bond to cover the possibility of defendant's attorney's fees on appeal. The reasons are 1, she thinks that Freeman is a despicable toad who will not comply with court orders. (Not McMahon's actual words but very close.)

Then Judge McMahon says, "defendants, what I need from you is an accounting of how many hours you worked on this case, what for, how many lawyers worked on what part, and how much all that cost, and I'll award a reasonable amount of attorneys fees."

Judge McMahon says that this case was actually really fucking easy to decide; you just had to read the books.

Judge McMahon notes that the point of the attorneys' fee shifting provision is to keep people from bringing unreasonable claims in the hope that they'll maybe get someone to settle rather than go to court, on the theory that they have nothing to lose.

She was under the, completely justifiable, assumption that no judge would actually just read both books. That it took 3 years for a judge to do that shows she was mostly right in that assumption.

I cannot imagine lying to a court about this? Lynne Freeman is a lawyer? What the hell is going through her brain?

For instance, Freeman claimed both heroines had grandmothers with green eyes, but her work does not contain a grandmother with green eyes, and in most of the versions of her work, her heroine didn't even have a maternal grandmother.

Going down the route of bad faith claims, Judge McMahon points out that even in the list of similarities provided, many of those similarities are lies. That is, some of the things called out as stolen from Wolff's books do not exist in Freeman's work.
