A short thread explaining trans exclusion in the law, and the Code of Practice, in response to a load of questions 🧵 Obviously this is necessarily simplified. I cannot write a legal textbook on Bluesky.

Explainer, there isn't a distinction between those things, really. The distinction is between what the law itself requires and what the guidance says.

This is why I have been purchased a mug that says "toilet lawyer" on it. Not what I dreamed of when I was younger as being an area of specialism, to be honest with you!

You can have a service only for people who wear high heels and that would similarly be potentially lawful. Even though high heel wearers not defined in law. It would be also indirect sex discrimination (males less likely to be wearing high heels) but if you had a good reason you could justify it.

Code of Practice doesn't address this, and that's just one reason why I think it gets the law wrong.

Actually I think it's yes in law, for this exact reason. If you offer a service on the basis of lived gender you aren't discriminating based on sex. So can be lawful. It's indirectly discriminatory on basis of sex (most of those who live as men are "biologically male") but potentially justifiable.

The weird thing is I used to spend hours and hours consumed by playing video games. I was, until FWS a mythic/cutting edge raider (sorry if you know what that means). But now if I even try to play Stardew Valley for a little bit I can't get into it because I know there is other stuff I need to do.

Yeah I actually think this is a really big factor. Let's be real, I have been working the ridiculous amount I have for 15 months now and was managing. The thing that has actually changed in the last several weeks is the heat.
