It can be appealed, but only after the judge's final ruling. Since this is just entering the discovery phase, then generally no. An Interlocutory order (appeal) can be made, but it is a HIGH bar hurdle to hurdle. He chose the lawsuit. He HAD to know discovery was Imminent.
