Hey what do you think about using the HDCA for this stuff, when it is online? I know what he says in the House or in a speech won't be covered, but when NZF or his social media accounts repeat it online?

The HDCA presupppses a targetted victim. Winston would need to make digital communications about a specific person that breaches or serious breaches one or more of the principles in the Act. So, yes, perhaps.

But the court recognises context. So, if your work requires online speech, particularly robust online speech, then the court may recognise you as having a higher tolerance than the average person. I think that will be true for politicians and political speech, unfortunately
