It’s obvious this is where it’s going. Since 1982, parliaments and legislatures have always used the SCC as a shield against politically unpopular decisions. Parliament already knows the SCC’s views on MAID. S.1 will not succeed against a s.7 claim for MAID for persons with mental illness.

That being said, at a certain point an argument on capacity could be made. Does a person with severe mental illness have the capacity to make this kind of decision?

I think we need to determine if Parliament has the capacity to make these decisions on behalf of others. They've shown plenty of evidence they do not have the capacity to do their job.

As a person this may apply to one day, I would like to retain this option. “Intractable suffering” is a real outcome of mental illness. If it stops responding to treatment, we consign humans to torture but we created options for a terminal cancer patient. Thanks for advocating this, Mr. Picard.
