"Just don't seat judges" is not an option available to you unless & until you have the White House and 60 votes in the Senate (yes, even with the nuclear option).

You seem unwilling to accept that attempting to slow processes down is a thing that is possible even if stopping them isn't. You also seem to think a seated GOP judge is better than a vacancy which shows you don't care about results
