like, I know what you're getting at, but i know actual people, including myself, whose copyrighted for-profit works were scraped without appropriate commercial reuse licenses being extended some of it is definitely grey, some of it is definitely not

sure they scraped mine as well of course. but its very much unclear if using something as training material like that is commericial reuse in a way that need to be licensed

sure, anything can be argued out in court, but I don't think it's as murky as you're saying when it comes to, say, books and movies. the only affirmative law here is free use (which this is not) and that it's illegal to pirate shit

anthropic settled with authors for a myriad of reasons, but i think the most obvious one is that if they lost, they were turbofucked, and this wasn't in their favor, not even close
