I think you’re idealising the German system and not recognising that it operates quite similar to the old Grammar School/Secondary Modern split. Specifically, people of ethnic minorities are way, way more likely not to go to Gymnasium than white Germans, and to be kicked out if they do get there.

Mate I live here. Any school system will have flaws. And German is not the easiest language to undertake exams if its your 2nd language. My niece who is half thai half German is a whizz at language and was made Klassensprecher aged 11 despite only being 8 when she moved here from Singapore.

If you live there you should be even more aware of how bad racial discrimination is in the selection of the kids who go to Gymnasium, rather than making excuses for it. Particularly the old language/eloquence chessnut! It is not merely a foible if ethnic minorities go there at 1/3rd average rate.

There simply isnt the hard dividing line on private to state schools there is here which means to a certain extent that well off parents calculate they can get what they want from a state school - this is a good thing for social mobility.
